Conflict of Laws

This course is an intro­duc­tion to the meth­ods used in Cana­di­an Law to resolve prob­lems that have a rel­e­vant for­eign ele­ment. Basic con­cepts include: the impact of the Cana­di­an Con­sti­tu­tion, the struc­ture of con­flict laws rules, domi­cile and res­i­dence, and proof of for­eign law, and spe­cial cas­es as recog­ni­tion of for­eign judge­ments, juris­dic­tion and the choice of law in cas­es with for­eign ele­ments. Appli­ca­tion to the prop­er­ty and casu­al­ty insur­ance indus­try with be emphasized.
